1. Definitions
In these Terms and Conditions:
- "Workshop" / "we" / "us" / "our" refers to escapementaad, operating from 38 Jalan Wong Ah Fook, 80000 Johor Bahru, Johor, Malaysia.
- "Customer" / "you" refers to any individual or entity that submits a watch for service or uses this website.
- "Service" refers to any watch repair, maintenance, or assessment work performed at the workshop.
- "Watch" / "Item" refers to any timepiece, movement, case, or component submitted to the workshop.
- "Intake Note" refers to the written condition record prepared at the point of drop-off.
- "Agreement" refers to the contract formed when a customer authorises the workshop to proceed with a quoted service.
2. Acceptance of Terms
By using this website or submitting a watch for service, you agree to be bound by these Terms and Conditions. These terms apply to all customers aged 18 and above. By submitting a watch for service, you confirm that you have the legal capacity to enter into a binding agreement and that you are the lawful owner of the item, or have the authority to authorise service on the owner's behalf.
3. Service Description
The workshop provides three categories of repair and maintenance service for mechanical and automatic watches:
- Timing Adjustment and Regulation (SVC-01)
- Sapphire Crystal Replacement (SVC-02)
- Comprehensive Service for Late-Model Mechanicals (SVC-03)
Services are available to customers in Malaysia. The workshop operates from Johor Bahru and does not currently offer postal intake. Service availability is subject to current bench capacity. We reserve the right to decline intake if a watch falls outside the defined scope of any of the three services.
4. Service Delivery Terms
Intake and assessment
A written intake note is prepared for every watch submitted. This note documents the condition of the watch at the point of receipt and forms part of the service record. The customer is responsible for providing accurate information about the watch's history and any known prior repairs.
Scope and changes
The published service scope covers standard cases. If work beyond the original scope is identified during service (for example, a damaged component requiring replacement beyond routine wear items), the workshop will contact the customer before proceeding. No work beyond the agreed scope is undertaken without the customer's explicit authorisation. If the customer declines additional work, the service will be completed to the extent possible within the original scope, and the watch will be returned at the quoted price.
Turnaround times
Indicative turnaround times are provided at intake. These are estimates and may vary depending on bench load, parts availability, and the outcome of initial assessment. The workshop will communicate any significant delays.
Collection
Customers are notified when their watch is ready for collection. Uncollected watches will be held for a period of 60 days from the notification date. After this period, the workshop reserves the right to charge a storage fee. Watches uncollected after 180 days may, at the workshop's discretion, be disposed of in accordance with Malaysian law, with proceeds applied against any outstanding fees.
5. Payment Terms
All prices are quoted and payable in Malaysian Ringgit (RM). The published prices for each service are:
- Timing Adjustment and Regulation: RM 540
- Sapphire Crystal Replacement: RM 1,650
- Comprehensive Service for Late-Model Mechanicals: RM 4,420
Payment is due in full upon collection of the watch. Accepted payment methods include cash and bank transfer. Receipts are issued for all transactions. Invoiced amounts will not exceed the quoted price unless additional work has been separately authorised by the customer in writing or by message.
Refund policy
Where work has been completed to specification and the watch collected, no refund is due. If work cannot be completed due to factors beyond our control after the intake note has been prepared, the watch will be returned at no charge. Where a service produces an outcome that falls materially short of the stated scope due to workshop error, we will assess the matter and offer an appropriate remedy, which may include re-work at no additional charge or a partial refund at our discretion.
6. Customer Responsibilities
- Customers must disclose any known prior repairs, modifications, or damage to the watch at intake. Concealed information that affects the service outcome may limit our liability.
- Customers submitting watches for service confirm they are the lawful owner or authorised representative.
- Customers are responsible for collecting their watch within a reasonable time after notification of completion.
- Website users must not attempt to interfere with the operation of the site, submit false information, or use the site for any unlawful purpose.
7. Intellectual Property
All content on this website — including text, images, diagrams, and design elements — is the property of escapementaad or is used with appropriate rights. You may not reproduce, distribute, or use site content for commercial purposes without written permission. Links to this website are permitted provided they are not misleading and do not suggest endorsement.
8. Disclaimers
Watch repair involves working with complex mechanical objects. While we follow manufacturer specifications and apply professional standards to all work, we cannot warrant specific results in every case — outcomes depend on the condition of the movement at intake, the availability of appropriate parts, and the inherent nature of working with aged mechanical components.
The workshop's written service reports document observed measurements and outcomes. They are factual records, not warranties of future performance. Watches are mechanical objects subject to continued wear; service intervals are recommendations, not assurances of trouble-free operation between services.
9. Limitation of Liability
To the extent permitted by Malaysian law, the workshop's liability for any claim arising from a service is limited to the amount paid for that specific service. We are not liable for indirect, consequential, or special damages, including loss of use or sentimental value. This limitation does not apply to claims arising from gross negligence or wilful misconduct.
We are not liable for delays or failures in performance resulting from circumstances beyond our reasonable control, including supply chain disruption, regulatory requirements, or natural events.
10. Indemnification
You agree to indemnify and hold harmless escapementaad and its staff from any claims, losses, or expenses (including reasonable legal costs) arising from your breach of these Terms, your misrepresentation regarding ownership or condition of a watch, or your misuse of this website.
11. Termination
Either party may withdraw from a service agreement before work has commenced, without penalty. Once bench work has begun, the customer remains liable for costs incurred to that point. The workshop may refuse or discontinue service if a customer acts in bad faith, provides false information, or creates conditions that make safe continuation of the work impractical.
12. Dispute Resolution
These Terms are governed by the laws of Malaysia. In the event of a dispute, we encourage customers to contact us directly at [email protected] to seek an informal resolution before initiating formal proceedings. If informal resolution is not possible, disputes will be subject to the jurisdiction of the courts of Johor Bahru, Malaysia.
13. General Provisions
- Entire agreement: These Terms, together with any written intake note and service quotation, constitute the entire agreement between the parties for the relevant service.
- Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force.
- Waiver: Failure to enforce any provision on one occasion does not waive the right to enforce it on a future occasion.
- Assignment: The workshop may not assign its obligations under these Terms without the customer's prior consent. Customers may not assign their rights under a service agreement to a third party without the workshop's written agreement.
14. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted on this page with a revised "Last Updated" date. Continued use of the website or submission of watches for service after changes are posted constitutes acceptance of the revised Terms. For ongoing service engagements, the Terms in effect at the time of intake apply.
